Florentina's release denied

Asistenta Florentina Cârstea rămâne în arest

Asistenta Florentina Cîrstea, de la maternitatea Giuleşti, va rămâne în arest, a decis Tribunalul Bucureşti care a admis contestaţia procurorilor faţă de decizia de eliberare a acuzatei. Procurorul de la Parchetul instanţei supreme a susţinut în faţa instanţei care a judecat contestaţia acuzării că, prin faptul că a părăsit salonul timp de 12 minute, asistenta a provocat moartea a şase bebeluşi.

În plus, procurorul de şedinţă a susţinut că asistenta a avut o atitudine oscilantă pe parcursul anchetei şi că aceasta prezintă în continuare un pericol pentru ordinea publică.

În replică, avocatul asistentei a subliniat faptul că plecarea timp de 12 minute din salonul micuţilor nu constituie cauza directă a morţii celor şase bebeluşi. Acesta a mai spus că asistenta "se chinuie din punct de vedere moral", având mustrări de conştiinţă, informează Mediafax.

Femeia este acuzată de ucidere din culpă şi de vătămare corporală. Asistenta Florentina Cîrstea, responsabilă cu salonul în care a avut loc tragedia, a fost găsită singura vinovată în acest caz.

Şase bebeluşi au murit şi cinci au fost grav răniţi în urma incendiului produs în 16 august, în Secţia de Terapie Intensivă prematuri de la Maternitatea Giuleşti.

Elena Mirea, mama Florentinei Cîrstea, asistenta de la Maternitatea Giuleşti acuzată de uciderea celor şase bebluşi, susţine că fiica ei este nevinovată. Aceasta arată cu degetul spre cei care aveau în întreţinere instalaţia care s-a defectat.

Femeia a sperat că fiica ei va ajunge curând acasă. Numai că săptâmânile au trecut şi acest lucru nu s-a întâmplat. Acum a răbufnit. "De ce a trebuit sacrificată?", se întreabă plângând mama asistentei.

Crede că de vină pentru tragedie este întreg sistemul sanitar, conducerea maternităţii şi oamenii care ar fi trebuit să verifice aparatele. Luni, când au primit vestea că Florentina va fi eliberată, au fost în al nouălea cer. Pentru scurt timp însă, pentru că procurorii au făcut recurs. Acum, cel care suferă cel mai mult este băiatul asistentei, în vârstă de 12 ani.

In replica, avocatul asistentei, Florian Surghie, a afirmat ca decizia judecatoriei a fost motivata in baza articolului 5 paragraful 3 din Conventia europeana a drepturilor omului, care statueaza cazurile si motivele de eliberare provizorie.

Totodata, avocatul a aratat ca prin masura impusa de instanta de fond, cea de eliberare provizorie sub control judiciar, se asigura in permanenta prezenta inculpatei in fata autoritatilor, precum si a organului de cercetare penala, a politiei sau a instantei de judecata.

Avocatul a aratat ca daca asistenta nu respecta strict obligatiile impuse de instanta care a eliberat-o, impotriva ei se poate lua oricand masura rearestarii.

Un alt aspect invocat de avocat a fost acela ca opinia publica si-a format deja o parere cu privire la tragedia de la Maternitatea Giulesti si la posibilii vinovati in acest caz, precizand ca punerea ei in libertate nu prezinta un pericol pentru ordinea publica.

Avocatul a subliniat faptul ca plecarea timp de 12 minute din salonul micutilor nu constituie cauza directa a mortii celor sase bebelusi, cauza reala fiind, asa cum o arata certificatele medico-legale, asfixia cu monoxid de carbon rezultat in urma izbucnirii incendiului.

Totodata, apararea a sustinut ca asistenta "se chinuie din punct de vedere moral", avand mustrari de constiinta, si ca mereu se gandeste la faptul ca daca ar fi fost in salon la momentul izbucnirii incendiului ar fi putut suna la 112 si i-ar fi putut salva pe acei bebelusi.

I am completely stunned. I cannot believe that one judge would over-rule another, cannot believe that this woman will remain in jail while murders and other known criminals walk free. Florentina has done nothing, nothing to merit this treatment, this abuse, this denial of her rights and freedom. To say that she is a 'pericol public' is such a load of tripe and everyone knows it perfectly well. To add that she has had mood swings and this makes her a danger to public order is hallucinating. Maître Surghie said she was 'morally struggling with remorse' - anyone who has seen babies burning to death and not been able to save them, been illegally arrested, had statements taken under duress (or possibly dictated? - see yesterday's post and comment from Investigarul), carried the weight of this tragedy all alone whilst the true culprits are investigated at liberty due to money and connections... and been branded as the most hated woman in Roumania by the gutter press would be struggling, too.

I sincerely hope that the case will now go to CEDO to be heard in a lawcourt where the law is actually applied for here in Roumania, it most certainly is not. That much is clear. Florentina's mother is absolutely right. The blame for the tragedy lies with the whole health system, the management of Giulesti Maternity and the people who ought to have checked the appliances/network. Not with this one nurse who was doing the job of at least three people, working a 12h shift where she left the room for 12 minutes. She was not responsible for the staff shortages, the bad scheduling, the lack of a crystal ball, the 9 year old aircon system that hadn't been overhauled in all that time... An outrage is an understatement.

Well, the ball doesn't stop rolling here. All the more furious, indignant and incredulous, we will continue to shout Florentina's innocence. Petitions will continue, blogs too, letters will be crossing Europe via email and snail mail and journalists will be bashed with articles and opinions, comments and views. This is a travesty of the very word JUSTICE and proves what everyone has been telling me for the last ten years - Roumanian justice is injustice. In this case there's no shadow of a doubt. Florentina is the official scapegoat and the Courts of Bucharest have allowed it to be so with legality even when her arrest was illegal, her statements gained incompetently, the paperwork fraudulent and the very first reason she was arrested (for lying) impossible, for she was interviewed by Iacob as a WITNESS and not as a DEFENDENT. She did not take the truth oath, thus she could not have lied (see Maitre Popescu's 'Denunt' document on the right of this page)...

Shame, shame, shame on the courts, the judge, the press who couldn't even report her release reliably. Shame on all those who have condemned her in advance and thus been instrumental to her incarceration. Shame on those in glass houses who have no right to throw stones, have no sense of empathy and compassion for a dedicated, sensitive woman whose life was her family and her tiny patients. SHAME!

I'm here for the first time. What I read is totally absurd. Did I understand well? There is a fire at the intensive therapy section of a Bucharest hospital and six babies die. The medical assistent who was taking care of the 11 newborns had just left the ward for 12 minutes to go to the lavatory, the exact moment when the wiring, due to faulty insulation with scotch tape, of the airconditioner caught fire. Mind you: this is one of the main hospitals in the capital, and it does not have central a/c. Moreover, there are wires and externsion cords all over the floor, linking the cables for the 8 incubators.. no insulation whatsoever, just.. scotch tape. Was it supposed to happen? Of course, but it was the worst moment, when the babies were unattended. And now, it's the nurse's fault. Not the manager's who is the administrator of the hospital; Not the head of technical services, responsible for the maintenance of the equipment; Not the head of the newborn section who should have scheduled at least three medical assistents for 11 babies, not ONE. Earlier that day, people remember, a dcotor asked her to assist while he was performing a C section,in another wing of the hospital, again she had to leave the babies unattended. Did I understand correctly that only the assistent is now in jail while all the others enjoy their freedom? Is this how justice is applied in Romania? Maybe someone can reply here...
